Take a moment to read this document, for it describes how you can and cannot use the information you learn through Eni Oken's lessons. (Keep in mind this is a very summarized version to make it easier for you, please read the COMPLETE TERMS OF USE HERE)


Rights and Restrictions are not always the same everywhere

It is important to understand that these "Do's and Donts'" are my own and can be different than other artists and art teachers. If you plan to use art for teaching or selling commercial products, then it is FUNDAMENTAL that you understand the different types of rights.

Here is an example of how two different companies might grant different rights:

Through my terms, I allow you to use your student work — as long as substantially different — for commercial products. You do not need any additional permission to create commercial products such as prints and mugs, but you must add visible credit in your product or store mentioning my design. As far as teaching goes, I do not permit teaching my unique lessons, since I'm a teacher who makes a living from those lesson plans.

Zentangle founders on the other hand, allow teaching and writing about anything they teach, but will not allow the use of the word "Zentangle" in product titles other than books. Additionally, you need to be certified to teach their method.

So you see how two different companies will grant different rights and restrictions.

These rights and restrictions are valid even if you plan to teach or distribute goods for free.

ALWAYS CHECK THE COPYRIGHTS, and if in doubt, contact me to get permission in writing to use my material and lessons.

These are some of the “DO’s AND DON’Ts” related to "Eni Oken's products and ebooks". Please read the COMPLETE TERMS OF USE HERE. 

The word "Lessons" refers to any ebook, tutorial or educational product sold through Eni's websites.

The word "Techniques" refers to a technique or method taught in any of Eni's ebooks, lessons, articles or tutorials. 

The word "Designs" refers to designs and artwork that is unique and original, found in the Lessons or on this website. 

The Zentangle® Method is an easy-to-learn, relaxing, and fun way to create beautiful images by drawing structured patterns. It was created by Rick Roberts and Maria Thomas. "Zentangle" is a registered trademark of Zentangle, Inc. Learn more at zentangle.com.

Some of the Lessons may refer and teach the Zentangle Method. Eni Oken is a Certified Zentangle Teacher, authorized to teach and write about the Zentangle Method.
 

 

What you CAN do:

  • You CAN download and store one copy of each Lesson on your computer.

  • You CAN download and store one copy of each Lesson on your mobile or tablet device.

  • You CAN print one copy of each Lesson exclusively for our own personal use.

  • You CAN reproduce Designs found in the Lessons for study and learning purposes only.

  • You CAN use these Lessons to learn new Techniques and create new original Designs of your own, substantially different from Eni's own Designs.

  • You CAN use your own Designs, substantially different than my own Designs, to create non-educational commercial products for sale.

 

What you MUST do:

  • You MUST remember that others may have used in the past or will use these Lessons and Techniques in the future.

  • You MUST remember that you are entirely responsible for any material you produce or any liability that might arise from your improper use of these Designs and Techniques.

  • You MUST hold Eni Oken and her company harmless for any and all activity related to the Lessons, Designs or Techniques. They are provided “as is” with no implied warranties.

  • You MUST read the Terms of Use and Privacy Policies found in this document here.

  • You MUST always include or give appropriate credits visibly: “Learned from Eni Oken at enioken.com" or substantially equivalent language.

 

What you CANNOT do:

  • You CANNOT duplicate, lend, email, mass print, display, distribute, republish, license, transfer, or use any of these Lessons, Designs and Content or Third Party Content found here for any other purpose that is not well defined here without written permission from Eni Oken or the respective copyright owners.

  • You CANNOT re-engineer, modify, or create derivative work from the Lessons or Designs found on this Website, unless EXPRESSLY agreed in writing by Eni Oken.

  • You CANNOT remove or obscure any intellectual property notices.

  • You CANNOT hold yourself as owner or creator of Content that is not yours.

  • You CANNOT use the Designs found in the Lessons or on this Website for any use without EXPRESS WRITTEN CONSENT.

  • You CANNOT use Designs which you have reproduced with the help of the Lessons, for commercial purposes.

  • You CANNOT use Designs derived from the Lessons for commercial purposes unless they are substantially different than my own.

  • You CANNOT TEACH Eni Oken's unique Lesson plans in anyway, electronically or online, that is, create tutorials, ebooks, articles, posts, videos, etc., based on these Lessons or Techniques without strict written authorization from Eni Oken Designs, Inc, even if you have recreated the text and images.

 


Here are some specific examples (please remember to read this entire document!)

Are you a STUDENT LEARNING FOR FUN?

Yes, you can post your work on social media giving Eni credit for the class, but don't record yourself doing it

  1. You CAN print the materials from the Lessons for your own personal use and download the files onto your own devices.

  2. You CANNOT lend or share your password or your materials with others.

  3. You CAN create your own work based on the lessons and post on social media. When you do, remember to give Eni Oken visible and appropriate credit, such as "Learned from Eni Oken, you can find more at enioken.com". 

  4. You CANNOT share the videos, cards, pdfs and materials from the Lessons. This means also that you CANNOT record yourself creating a piece learned from the Lessons (or post numerous step-out images) since this would be the same as reproducing the Lessons.

  5. You CAN print your own pictures created from the Lessons to be used as a card or wall painting to give to family and friends, not mass produced.

  6. Read the complete terms for more details of what you can or cannot do.

Are you aN ARTIST creating PRINTED GOODS for sale?

Yes, you can create your own artwork for commercial use, if it's visibly different

  1. You CAN use these Lessons to learn how to create your own art for non-educational commercial products.

  2. The art that you create and use must be substantially different than the Art in the Lessons. What does that mean? It means that a LAYPERSON (someone who does not know about art or Zentangle) cannot tell that your pictures are similar to the Lessons.

  3. You MUST always include or give appropriate credit visibly: “These designs were learned and derived from Eni Oken's Lessons”, or equivalent language.

  4. You MUST remember that others might use or have used these lessons as well.

  5. You MUST remember that you are entirely responsible for any material you produce or any liability that might arise from your improper use of these Designs and Techniques.

  6. You MUST hold Eni Oken and her company harmless for any and all activity related to the Lessons, Designs or Techniques. They are provided “as is” with no implied warranties.

Are you AN ART teacher or czt?

NO, you cannot teach Eni's unique classes:

  1. Most of Eni Oken's classes are UNIQUELY designed and crafted into careful Lesson plans. Learning a Lesson through Eni Oken Designs does not grant you permission to teach the Lesson online or electronically in any way, EVEN IF YOU RECEIVE NO COMPENSATION or even if you create your own art. Do not post yourself drawing a project you learned through a teacher on youtube or instagram, as you are effectively teaching that class!

  2. Understand the differences. Art Techniques can be taught by anyone; Designs are copyright protected. Understand the distinction before coming up with your own class. A Technique is something like coloring, painting, hatching. A Design is an expression of a technique, such as a Lesson Plan or Project, Exercise, Hand-outs, Videos, Lesson project, etc, all which are copyrighted.

  3. Be respectful. When designing your own Classes and Lessons, avoid teaching a similar technique that has been taught by Eni Oken or any other art teacher, if you can help it. Respect your peers.

  4. Additionally, many of Eni's classes include methods and processes that she has developed on her own. Although Techniques cannot be copyrighted, respect between professionals is encouraged; avoid teaching techniques or procedures that are not your own and which have become part of a teacher's unique branding.

  5. Do your research. When designing a project for your own Classes and Lessons, do everything you can to create really different and unique Designs of your own, especially when using a popular technique.

  6. Zentangle's founders come up with many Lesson plans that are considered public and available for any CZT to teach. Some of Eni's classes cover those topics. You CAN teach those techniques and designs as long as they are based on the original proposal by Zentangle. You may NOT include any modifications done by Eni Oken.

Final note: until February 2021, Eni Oken Designs allowed Art Teachers and CZTs to teach her unique Lessons in a live, in person setting only. Since then, excessive posting on social media by students of third party teachers has caused confusion, so this exception has been revoked. Thanks for understanding.
